The Platform is intended for individuals preparing for standardized tests. By using the Platform, you represent that you are at least 13 years old or have the consent of a parent or legal guardian. If you are under 18, your parent or guardian is responsible for your use of the Platform.

You are responsible for maintaining theconfidentiality of your account credentials and for all activity occurringunder your account. You agree not to share or sell your login credentials. If you believe your account has been compromised, you must notify us immediately.

All content on the Platform—including but not limited to videos, practice questions, written explanations, graphics, logos, and other materials—is the property of Test Prep and protected by United States and international copyright, trademark, and intellectual property laws.

You may use the content solely for personal, non-commercial study purposes. You may not copy, redistribute, reproduce, or create derivative works without prior written consent.

The SAT® exam is owned by the College Board, which is not affiliated with, endorsed by, or sponsored by Penguin Test Prep.

By posting, uploading, or otherwise submitting content to the Platform (including comments, posts, or other contributions), you grant Test Prep a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content in connection with operating the Platform.

Test Prep makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the Platform or its content. Your use of the Platform is at your own risk. We do not guarantee uninterrupted access or error-free operation.

To the maximum extent permitted by law, Test Prep shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising out of your use of the Platform, even if we have been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless Test Prep, its affiliates, employees, and partners from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or misuse of the Platform.

We may suspend or terminate your account or access to the Platform at any time, with or without notice, if we believe you have violated these Terms or for any reason at our sole discretion.

When sharing Test Prep resources on social media or other platforms, you agree to give proper credit and not represent the resources as your own original work. Unauthorized use may result in termination of access and possible legal action.

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Colorado Springs, Colorado, and you waive any right to participate in a class action lawsuit.​

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect

Penguin Test Prep may revise these Terms at any time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
